Terms of Use Agreement

Effective date: April 26, 2021

Welcome to MissyQuai Signature Hair, a marketplace platform designed to allow customers (“customers”) to purchase [hair] (“products”) and to request styling services (“stylist services”) in connection with such products from stylists (“stylists”).

Please read these terms of use agreement (“Agreement”) carefully. This agreement is a legal contract between you (“user”) and MissyQuai Signature Hair, inc. (“MissyQuai Signature Hair,” “we,” or “us”). Section 15 of this agreement is an arbitration clause that requires most disputes between us to be resolved on an individual, non-class action basis through binding and final arbitration instead of in court. See section 15 for more information regarding this arbitration clause and how to opt out.

By accessing or using www.missyquai.com or any other website with an authorized link to this agreement (“Website”), registering an account, making any purchases, or accessing or using any content, information, services, features, or resources available or enabled via the website (collectively, the “services''), or clicking on a button or taking another action to signify your acceptance of this agreement, you: (1) agree to be bound by this agreement, and any future amendments and additions to this agreement as published through the services; (2) represent you are of legal age in your jurisdiction of residence to form a binding contract, and (3) represent that you have the authority to enter into this agreement personally and, if applicable, on behalf of any company, organization or other legal entity on whose behalf you use the services.  unless otherwise specified, “you” refers to both customers and stylists. If you disagree with being bound by this agreement, you may not access or use this website or the services.

Product order process.

(a) Order acceptance.  Each part of any order you submit to MissyQuai Signature Hair constitutes an offer to purchase. If you do not receive a message from MissyQuai Signature Hair confirming receipt of your order, please contact our customer service department at www.missyquai.com before re-entering your order. MissyQuai Signature Hair’s confirmation of receipt of your order does not constitute MissyQuai Signature Hair's acceptance. MissyQuai Signature Hair is only deemed to have accepted your order once the product(s) you ordered have been shipped.

Products ship within 1-3 business days from your order date.  During Major sales and promotions, orders may take  7 to 10 business days for orders to process. Processing times for custom full lace wigs will take up to 60 business days for production.

 Order processing begins as soon as an order is submitted. As a result, order modifications are not permitted after an order is submitted. This includes changes to products, shipment methods, addresses, cancellations, etc.

 Expenses associated with delayed or incorrect orders-MissyQuai Hairb is not responsible for your hair appointment cancellation fees assessed by your Hair Stylist/Salon. We ask that you receive and confirm all items purchased before confirming any and all hair appointments. MissyQuai Hair is also not responsible for the installation of the products purchased on our website and stores. All returns and return-to-shipper shipments will incur a flat restocking fee of $30.

(b) Order issues.  Although we strive to accept all valid orders, MissyQuai Signature Hair reserves the right to deny any order for any reason, including if: (i) we discover an error in pricing and/or other information about the product or receive insufficient or erroneous billing, payment, and/or shipping information, (ii) we suspect an order has been placed using stolen payment card information or otherwise appears to be connected to fraud, or (iii) the ordered product is unavailable due to discontinuance or otherwise. we may also refuse any order that is connected with a previous payment dispute. 

(c) Return policy. Any request to return products shall be made per our return policy: https://missyquai.com/returns. We do not accept returns or exchanges for any products customized by stylists. All fees paid for products and/or styling services are non-refundable.

(d) Order cancellation.  If any product is discontinued or otherwise unavailable, MissyQuai Signature Hair reserves the right to cancel your order and provide you with a refund for the amount paid.

(e) Restrictions on resale. To protect the intellectual property rights of MissyQuai Signature Hair and its licensors and suppliers, any resale of products for personal and/or business profit is strictly prohibited. MissyQuai Signature Hair reserves the right to decline any order that we deem to possess characteristics of reselling.

(f) Third-party provider. MissyQuai Signature Hair uses a third-party service provider for fulfilling orders. By ordering any product through the services, you acknowledge that MissyQuai Signature Hair has no responsibility or liability for any delays that may result from orders handled by such third-party service providers.

Fees and Purchase Terms.

(a) Payment.  You agree to pay for all orders from your account per the prices and billing terms in effect when an order is made. You also agree to pay all applicable taxes. To order through the services, you must provide valid payment information, such as a credit card (Visa, Mastercard, or any other issuer we accept) or a PayPal account. By providing your payment information, you agree that MissyQuai Signature Hair is authorized to immediately invoice your account for all charges due and payable to MissyQuai Signature Hair hereunder and that no additional notice or consent is required. You agree to immediately notify MissyQuai Signature Hair of any change in your billing address, debit card, credit card, or PayPal account used for payment. MissyQuai Signature Hair uses Stripe as a third-party service provider for payment services (e.g., credit card transaction processing, merchant settlement, and related services). Using the services, you consent and authorize MissyQuai Signature Hair to share any information and payment instructions you provide to complete your transactions. You agree to immediately notify MissyQuai Signature Hair of any change in your payment information by emailing www.missyquai.com/updating the information in your account. MissyQuai Signature Hair reserves the right to change its prices and billing methods at any time. Please contact www.missyquai.com regarding any billing disputes.

Terms of payment are always 100% upfront. We accept most major credit cards, Shop Pay, After Pay, and Shop Pay Installments. Prepaid and virtual cards are not accepted on this website.  As soon as you place an order online, your credit card will be charged. Credit card fraud and theft of our merchandise will be lead to prosecution to the fullest extent of the law.

 MissyQuai Hair reserves the right to request additional payment and shipping verification after an order is submitted. Medium to High Fraud orders will be automatically canceled.

 Orders placed online may not be picked up in stores.

 All International orders must be paid using the PayPal checkout option. International orders without PayPal Seller Protection will be automatically canceled.

 By purchasing you agree to the following terms and conditions:  You have read the product description and understand the product that you are receiving.  You understand and agree to our refund policy.  You understand that once an order is submitted changes or cancellations can not be made (including item changes, shipping address changes, etc).

(b) Discounts and promo codes. In our sole discretion, we may create discounts and promotional codes that may be redeemed for credit in your account or other features or benefits, subject to any additional terms we establish on a per-promotional code basis (“promo codes”). Promo codes may only be used once per person. Only promo codes sent to you through the official MissyQuai Signature Hair communications channels are valid. You agree that promo codes: (i) must be used for the intended audience and purpose and in a lawful manner; (ii) may not be duplicated, sold, or transferred in any manner or made available to the general public (whether posted to a public forum or otherwise), unless expressly permitted by us; (iii) may be disabled by us at any time for any reason without liability to us; (iv) may only be used according to the specific terms that we establish for such promo code; (v) are not redeemable for cash; and (vi) may expire before your use.

obscene, or profane; (iii) constitutes unauthorized or unsolicited advertising, junk or bulk e-mail; (iv) involves commercial activities and/or sales without MissyQuai Signature Hair’s prior written consent, such as contests, sweepstakes, barter, advertising, or pyramid schemes; or (v) impersonates any person or entity, including any employee or representative of MissyQuai Signature Hair. You may not send any unsolicited e-mail message, commercial or non-commercial, to any e-mail address you have gathered from the services.

or in the services are the property of their respective owners. You will not remove, alter, or obscure any copyright notice, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the services. 

The implied warranties or conditions of merchantability, fitness for a particular purpose, title, and non-infringement arising from the products and services.

Products. Descriptions, images, references, features, content, specifications, products, prices, and availability of any products are subject to change without notice. Our current prices can be found on the services. We make reasonable efforts to accurately display the attributes of our products, including the applicable colors; however, the actual color you see will depend on your computer system, and we cannot guarantee that your computer will accurately display such colors. Including any products on the services at a particular time does not imply or warrant that these products will be available at any time.

There is no liability for the conduct of third parties or products. You acknowledge and agree that the MissyQuai Signature Hair indemnitees are not liable, and you agree not to seek to hold MissyQuai Signature Hair indemnitees liable for the conduct of third parties or any products or services that they may provide,
